Welcome to Kaimana Reefworks. These Terms of Service govern your use of our website and your purchase of products from us. By visiting our site or placing an order, you agree to be bound by these Terms of Service and our posted policies, including our Return & Refund Policy, Shipping Policy, and Privacy Policy. 1. Use of This Website

By using this site, you represent that you are at least the age of majority in your state or territory of residence, or that you are using the site with the involvement and consent of a parent or legal guardian.

You agree not to use this website or our products for any unlawful or unauthorized purpose. You also agree not to interfere with the security, functionality, or proper operation of the website.

2. Product Information and Availability

We make every effort to present our products as accurately as possible. However, we do not guarantee that product descriptions, availability, pricing, images, or other content on the site are always complete, current, or error-free.

Because we sell live animals, live feeds, and specialty aquarium products, availability may change without notice. We reserve the right to limit quantities, discontinue products, substitute packaging where appropriate, or cancel orders at our discretion.

3. Live Animal and Live Product Disclaimer

Kaimana Reefworks sells live marine fish and live feeds, including copepods, phytoplankton, and rotifers. These products are perishable and sensitive to shipping conditions, handling, tank environment, and husbandry.

We do not guarantee long-term survival, health outcomes, compatibility with existing livestock, or performance in a customer’s system after delivery. Customers are responsible for ensuring they have a suitable, stable, and properly maintained environment before ordering live goods.

Any live-arrival coverage is governed solely by our posted Return & Refund Policy.

4. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to change prices at any time without notice.

You agree to provide current, complete, and accurate billing, shipping, and payment information for all purchases. If we believe an order contains inaccurate information, pricing errors, or suspected fraud, we may refuse, cancel, or limit the order.

5. Order Acceptance and Cancellation

Your order is an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order at our discretion, including for suspected fraud, inventory issues, shipping risk, pricing errors, or product unavailability.

Orders may be canceled by the customer only if they have not already entered processing, as described in our Return & Refund Policy.

If we are unable to fulfill or ship an order as promised and the customer does not agree to a delay, FTC guidance says the seller generally must issue a refund for the unshipped merchandise. If no shipment timeframe is stated, online sellers generally must have a reasonable basis to believe they can ship within 30 days.

6. Shipping and Delivery

We ship live and non-live goods according to our posted Shipping Policy.

Shipping dates and delivery estimates are not guaranteed unless explicitly stated. Carrier delays, weather events, routing issues, and other circumstances outside our control may affect delivery timing. The FTC’s Mail, Internet, or Telephone Order Rule requires sellers to ship within the advertised time, or within 30 days if no time is promised, unless the customer agrees to a delay.

For live goods, someone must be present to receive the package on the first delivery attempt. We are not responsible for losses caused by missed delivery attempts, unattended packages, incorrect shipping information, delayed unpacking, or unsuitable receiving conditions, except as expressly stated in our Return & Refund Policy.

We reserve the right to hold or delay live shipments when weather conditions or transit risks make safe delivery unlikely.

7. Returns, Replacements, and Store Credit

Returns, replacements, and store credit are governed by our posted Return & Refund Policy.

Nothing in these Terms of Service limits any rights that cannot legally be waived. For example, if a seller cannot ship unshipped merchandise and the customer does not consent to delay, FTC guidance requires a refund rather than forcing store credit.

8. Customer Responsibilities

By placing an order with Kaimana Reefworks, you agree that you are responsible for:

providing an accurate shipping address and contact information
being available to receive live deliveries on the first delivery attempt
unpacking and inspecting shipments promptly
maintaining appropriate water quality and husbandry conditions
researching livestock compatibility and system suitability before purchase

We reserve the right to deny claims when the required documentation is not provided, the claim window is missed, or the issue appears to result from customer handling or unsuitable system conditions.

9. Intellectual Property

All content on this site, including text, images, logos, graphics, product names, branding, and design elements, is the property of Kaimana Reefworks or its content suppliers and may not be copied, reproduced, distributed, modified, or used without prior written permission.

10. Prohibited Uses

You may not use this site:

for any unlawful purpose
to violate any local, state, federal, or international law
to infringe on our intellectual property rights or the rights of others
to submit false or misleading information
to upload malicious code, spam, or harmful material
to interfere with the site’s operation or security

To the fullest extent permitted by law, Kaimana Reefworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or purchase of products from us.

Our total liability for any claim relating to a product or order shall not exceed the amount actually paid for that product or order.

This limitation does not apply to any liability that cannot be limited under applicable law.

13. Indemnification
